Eichler Kern Klein successfully represented Heumann Pharma and Heunet Pharma before the Düsseldorf Higher Regional Court. The OLG confirmed that the supply chain award criteria used in the context of a rebate contract tender by the AOK are contrary to procurement law. The application for review was successful despite the award of the contract announced in the course of the appeal proceedings!
